Terms of Service

1. Agreement to Terms

By accessing or using Super RMBG ("the Service") at super-rmbg.shop, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Super RMBG provides an AI-powered image background removal service. Users can upload images and receive processed versions with the background removed. The Service operates on a credit-based system where each successful background removal consumes one credit.

3. Account Registration

  • You must sign in using a valid Google account to use the Service.
  • You are responsible for maintaining the security of your account and all activities that occur under it.
  • You must provide accurate information and keep it up to date.
  • You may not create accounts for the purpose of abusing the free credit system.
  • We reserve the right to suspend or terminate accounts that violate these terms.

4. Credits and Payments

4.1 Free Credits

New users receive 3 free credits upon registration. Free credits are non-transferable and provided for evaluation purposes only.

4.2 Credit Packs (One-Time Purchase)

  • Credit packs are one-time purchases that do not expire.
  • Credits are non-transferable between accounts.
  • Pricing is as displayed at the time of purchase.

4.3 Monthly Subscriptions

  • Subscription credits are allocated monthly and reset at the beginning of each billing cycle.
  • Unused subscription credits do not roll over to the next month.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

4.4 Credit Deduction

One credit is consumed per successful background removal. Credits are deducted in the following priority order: free credits → subscription credits → purchased credits. If processing fails due to a system error, the credit will be automatically refunded.

5. Refund Policy

  • Credit Packs: Due to the digital nature of the product, credit packs are generally non-refundable once purchased. If you experience a technical issue that prevents you from using purchased credits, please contact us within 14 days of purchase.
  • Subscriptions: You may cancel your subscription at any time. No refunds are provided for partial months. If you cancel, you retain access to your subscription credits until the end of the current billing period.
  • Failed Processing: If background removal fails due to a server or API error, the credit is automatically refunded to your account. No action is needed.

6. Acceptable Use

You agree not to:

  • Upload images that contain illegal, harmful, abusive, or offensive content
  • Upload images that infringe on the intellectual property rights of others
  • Use the Service to process images containing child exploitation material
  • Attempt to circumvent usage limits, exploit bugs, or abuse the credit system
  • Use automated scripts or bots to access the Service without prior authorization
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Share, resell, or redistribute your account credentials

7. Intellectual Property

7.1 Your Content

You retain all ownership rights to the images you upload. By uploading an image, you grant us a limited, non-exclusive license to process the image solely for the purpose of providing the background removal service. We do not claim any ownership of your uploaded or processed images.

7.2 Commercial Use

Images processed using paid credits may be used for commercial purposes, provided you have the necessary rights to the original image. Images processed using free credits are for personal and evaluation use only.

7.3 Our Service

The Service, including its design, code, features, and branding, is the intellectual property of Super RMBG and is protected by applicable intellectual property laws.

8. Service Availability and Quality

  • The Service is provided "as is" and "as available" without warranties of any kind.
  • We do not guarantee that the background removal results will be perfect for every image.
  • We may temporarily interrupt the Service for maintenance, updates, or improvements.
  • We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

9. Limitation of Liability

To the maximum extent permitted by law, Super RMBG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

Our total liability for any claims arising from the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Super RMBG and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator is established, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of that jurisdiction.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.
